KILROY - Terms and conditions

NB: Please note that all your bookings in relation to the KILROY Impact Challenge are purchased through KILROY Denmark / Horizons (CVR: 11153380). Reach out if you are in doubt and whether it will impact your rights for potential cancellation and refunds. Also, in all communication going forward will be in English (as we have multiple nationalities joining)


TERMS AND CONDITIONS  


1. The Agreement 

1.1 By agreeing to these terms and conditions, the customer confirms the booking. The agreement is binding on both parties when KILROY has received a confirmation from the partner / supplier, full payment has been received and the booking is confirmed to the customer. In case there is no availability left on the booked tour / tours the customer will be contacted and offered an alternative. 

1.2 KILROY travels is dependent on the partner / supplier for correct information and KILROY reserves the right to refund the purchase price if the tour is cancelled. 

 

2. Liability 

2.1 KILROY acts as agent for various tours and tour providers. This means that only those providers / partners are responsible for providing the travel services on-site. The general conditions of the individual providers apply. 

2.2 KILROY cannot be held responsible for changes which the provider makes to departures, itineraries or when a tour is cancelled. In all cases, the client will be offered an alternative, before a refund is given. 

2.3 Nothing in this Agreement shall exclude or limit Our liability for (i) fraud or other criminal act, (ii) personal injury or death caused by the negligence of Our employees in connection with the performance of their duties hereunder or by defects in any product supplied pursuant to this Agreement, or (iii) any other liability that cannot be excluded by law. 

2.4 No event will We be liable under this Agreement for any damages resulting from: (i) cancellation of flights or costs resulting from missed flights, (ii) loss of opportunity, and/or (iii) any indirect or consequential loss. Such liability is excluded whether such damages were reasonably foreseeable or actually foreseen. 

2.5 We will not accept any responsibility for any illness, accident or loss, weather conditions, fire, civil or military disturbance, criminal activity, industrial action, mechanical breakdown, quarantine, border closures, government intervention or other event of force majeure where such events arise for reasons other than Our negligence. Although such circumstances are beyond our control, We shall make every effort to provide You with assistance if You are in difficulty. Should it become necessary to abandon a Trip/Experience because of such an event, we will be entitled to retain such monies received necessary to cover costs incurred. 

2.6 You accept that weather conditions may prompt the cancellation of scheduled events within a trip/experience, and that we cannot be held responsible for such cancellations. No reimbursements will be made for events or activities lost to bad weather. 

2.7 We accept no liability in respect of products or services procured by You from Third Party Suppliers or in respect of activities undertaken by You that are outside of those specified for Your Trip/Experience. 

 

3. Passport, visa and health regulations 

Each traveler is responsible for complying with the required passport, visa and health regulations. Consult the proper authorities such as embassies, doctors, health centers etc. Information provided by KILROY on these matters is purely advisory and as such KILROY cannot be held responsible for the customer not complying with the required documents and rules. 

Please note that for some countries the passport needs to be valid for at least 6 months after arrival and that it is generally not possible to enter a country on a one-way ticket/trip. 

 

4. Travel insurance 

Each traveler is responsible for taking out travel insurance coverage. Many things are not, or only partially covered by standard (national) health insurance. Supplemental coverage is recommended. Ask our travel experts for more information. 

Be aware that when the return date is changed to a later date, the insurance must be extended. This is the traveler's own responsibility. Each participant on the Interrail Impact Challenge is required to have travel insurance during the duration of their trip. 

 

5. Acknowledgement of risk 

Each traveler recognizes and acknowledges that there is always risk involved in traveling. In recognition of this, and for the consideration set forth in this agreement, each traveler elects voluntarily to enter into this agreement and assume all risks of loss, damages, injury or death that may be sustained. 

  

6. Health and Safety 

6.1 While we are committed to ensuring the safety of Our clients, We do not accept liability for any negligence on the part of Third Party Suppliers or any other agents used by You, which are not connected to Your Trip/Experience.  

6.2 You accept that all sports and travel carry some risk of personal injury. You have the right to refuse the taking of any risks which You believe may endanger Your health and safety, or which are not covered by Your insurance and You agree that We will not be held liable for any injury or damage caused to You where You have taken a risk willingly, and the injury or damage arose other than as a result of Our negligence. 

6.3 You accept that the health facilities in Your Trip/Experience country may be of a lower standard to Your home country and consequently may not provide the level of treatment You expect in the case of an emergency. 

 

7. Changes to website 

7.1 The Company reserves the right to: 

7.2 Change or remove (temporarily or permanently) the Website or any part of it (including, without limitation, changes to the layout, functionality or ‘look and feel’ of the Website, and the information made available on the Website) without notice and you confirm that the Company shall not be liable to you for any such change or removal; and 

7.3 change these Terms and Conditions at any time, and your use of the Website following any such changes shall be deemed to be your full acceptance of those changes. 

 

8. Changes to Terms and Conditions 

These Terms and Conditions are subject to change at the discretion of the Organizer and such changes shall be published on this website. The Participant is advised to check the Terms and Conditions regularly. 

 

9. Security 

If you choose to send any electronic communications to the Company by means of the Website (whether by means of email or through forms made available on the Website), you do so at your own risk. We cannot guarantee that such communications will not be interrupted or changed or that they will reach the intended recipient safely. 

 

10. Communications 

10.1 By entering the Event the Participant agrees to receiving essential Event specific communications from KILROY by emailsms, or phone. The Participant is unable to unsubscribe from these communications. 

10.2 By entering the Event the Participant consents to receiving marketing communications from the Organizer by email about this Event, and other Events arranged by the Organizer. The Participant can unsubscribe from these communications at any time. 

 

11. Statutory Rights 

These Terms and Conditions do not affect the Participants statutory rights as a consumer. 

 

12. Customer obligations 

12.1 It is the responsibility of the customer to ensure that the information provided to KILROY and its partners is correct. Information on age and study is always registered. It is extremely important that the first and last name in the passport match the provided information. If this is not the case, then please contact KILROY. 

12.2 Incomplete or incorrect provision of this information can have serious consequences and could lead to refusal on the booked travel services. KILROY is not liable for any additional costs caused by incomplete or incorrect information provided. 

All documents are personal and non-transferable. 

 

13. Privacy 

13.1 In order to improve our website and better serve website users, we may use software tools or ‘cookies’ to gather information about the browsing activities of visitors to the Website. A cookie is a piece of technology, sometimes called a text file, that is sent from a web server to a web browser enable the browser to remember certain information. The information held by a cookie can only be read by the person who sent it. The information that may be gathered includes the dates and times of visits, pages viewed, time spent at the site and the sites visited just before and just after visiting the Website. 

13.2 If you provide any personal data to the Company through the Website, such data may be processed by the Company or any member of its group (including third party agents and companies based in countries where data protection laws might not exist or be of a lower standard than in the EU) for the purposes of aiding in the operation, design, marketing and/or promotion of present and future products and services of the Company and/or members of its group. The Company is committed to protecting your privacy and will take all reasonable steps to ensure that your personal data are kept secure against unauthorized access, loss, disclosure or destruction. If you wish, you may also have a copy of any of your personal data that the Company holds. The Company may, as allowed by law, charge a fee for this. 

 

14. Complaints 

If the trip differs significantly from the original, the customer is required to notify the operating partner or supplier as soon as possible. If the local travel partner or supplier is not available, please contact KILROY immediately. A complaint made after the trip has ended, should be completed - in writing - no later than six weeks after returning from the trip. In any cases of discrepancies or complaints concerning your purchase, please do not hesitate to contact us. Should you for any reason not be satisfied with the outcome, KILROY obliges to inform you that you may refer your case to The European Commission’s Online Dispute Resolution. 

 

15. Interrail Terms and Conditions

16. Legal information 

16.1 Reservations are made for printing errors, technical errors and changes in prices outside KILROY's control. Any claim against KILROY Denmark A / S must be settled in accordance with Danish law. Complaints or actions which cannot be decided by the Travel Appeals Board must be decided by the Danish Maritime and Commercial Court. 

16.2 As the airlines provide the journey, they are therefore responsible for any delays, cancellations, bankruptcy, baggage problems and other conditions during the journey. This means that any requirements and complaints relating to your trip must be addressed directly to the airline.

17. Image Rights 

Photography and videography will be taken during the Event and the Participant consents to be included in these and agrees to waive all rights to photography/videography that features the Participant and grants the Organizer to sole and complete permission and authority to use the Photography/Videography in any worldwide media. 

Photography, film, video and sound recordings of the Participant may be taken during the Event and the Participant consents to be filmed and/or photographed and/or included in sound recordings of the Event. 

 

18. Media Rights 

18.1 The Team undertakes on behalf of itself, each Team Member and any other persons associated with the Team that it and they hereby consent in perpetuity and on a royalty-free basis throughout the Territory to: 

18.2 the use of their names, initials, nicknames, signatures, photographs, likenesses, voices, quotations, biographical details, fame and reputation, the name and photograph of the Team's Vehicle, the names and logotypes of the sponsors and suppliers who appear on the Vehicle and on the Team's clothing: 

18.3 in all contexts; 

18.4 in all media (including New Media) now known or hereafter devised, including, without limitation, theatrical exhibition in cinemas, all forms of television and radio broadcasts, all print media (including, without limitation, all consumer and trade magazines and catalogues, newspapers and other periodicals), posters, banners, street vision monitors, airliners and ships, in-store ads and all other point of purchase advertising and promotional materials, train and bus wraps, mobile phones, direct mail, billboards, and internet sites, 

18.5 for all advertising, promotion, endorsement, broadcast, merchandising and/or gaming purposes of the Company, the Commercial Partners and any other approved third parties at the discretion of the Company. 

 

19. Cancellations  

19.1If you choose to cancel your trip more than 30 days before departure, we will convert your deposit into a KILROY gift card (valid 3 years), which can be used against any product or service we offer. The deposit equals 10% of your trip. If you made full payment by this time, it will also be refunded in full.  

19.2 Cancellation due to COVID-19 

In the case that we must cancel the event you have signed up to because of an outbreak of COVID-19 in the event destination country(s) (Istanbul, with the back-up destination of Athens) we will offer you: 

  • A full refund of the entry-fee amount you have paid. You are covered by the EU Package Travel Directive and will get the full travel cost reimbursed (including deposit). 

OR 

  • A refund in the form of a KILROY gift card that you have 3 years to redeem on any product sold by a travel advisor if within 30 days from departure. 

 

19.3 COVID-19 Policy  

Cancellation 

In the case that we must cancel the event you have signed up to because of an outbreak of COVID-19 in the event destination country(s) (Istanbul, with the back-up destination of Athens) we will offer you: 

  • A full refund of the entry-fee amount you have paid. You are covered by the EU Package Travel Directive and will get the full travel cost reimbursed (including deposit). 

OR 

  • A refund in the form of a KILROY gift card that you have 3 years to redeem on any product sold by a travel advisor. 

19. 4 Retrospective refund request at point of event cancellation or postponement 

If you have pulled out of the event and are issued a refund based on our normal refund policy, and the event is later cancelled or postponed due to an outbreak of COVID-19, you will not be entitled to come back at the point of event cancellation or postponement for a full refund as you will already have ended your contract with us. 

19.5 Disinclination to travel 

We won’t refund your entry fee if you have a disinclination to travel due to a perceived threat of COVID-19 and the event is going ahead. 

19.6 If you are infected with COVID-19 

If you need to withdraw from the event because you have contracted COVID-19, a refund will be given at the sole discretion of the company and on presentation of a medical certificate proving infection. 

19.7 Immunity Certificates or other types of COVID-19 control documents 

You may be required to obtain an immunity certificate or some other kind of documentation to prove that you are not actively infected with COVID-19. If you are unable to travel because you do not have the correct documents relating to COVID-19, we will be unable to refund you. 

19.8 Quarantine, health and security regulations 

You may be expected to quarantine for a period of time on arrival in the event destination country. You may also be expected to do the same in your country of residence when returning from your trip. You may need to take this into consideration when planning your schedule to take part in the event. We will not issue a full refund to you if you sign up with the understanding that this, amongst other travel regulations, is a possibility, and then later decide you do not wish to comply with these regulations and so want to withdraw. These regulations are likely to become a part of post-COVID-19 travel for a little while, so please take them into consideration. It is your responsibility to clearly understand any potential quarantine requirements to destinations on your route or in your home country upon your return. 

19.9 Regional entry restrictions 

If the country in which the event is taking place introduces regional lockdown zones, we will move the location of the event if we can. If we can’t do this because the lockdown zones are so restrictive, and we are unable to deliver a satisfactory event for you, we may cancel the event and the above rules will apply. We aim to confirm the final destination of the KILROY Impact Trip on June 4th, but hold the right to push back this deadline to a later date if needed.  

19.10 Things might change 

COVID-19 is constantly impacting the travel landscape and we do not have all the answers. Fortunately, the nature of the Interrail Impact Challenge allows for flexibility in case things change and we need to alter the trip route, volunteer destinations or final party location. We will update our policies as they change where relevant.
